Terms of Service

These Terms of Service ("Terms") govern your use of the CaddiQ mobile application, the website at caddiq.com.au, and any related services (together, the "Service"). The Service is provided by UJENGA PTY LTD, ACN 667 735 506, ABN 97 667 735 506, of Moggill QLD 4070, Australia ("CaddiQ", "we", "us", "our").

By installing, accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 17, you confirm you have parental or guardian consent. By using the Service you represent that you have the legal capacity to enter into a binding agreement.

2. Your account

You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately at support@caddiq.com.au if you suspect unauthorised use.

3. Licence to use the Service

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the CaddiQ app on devices you own or control, and to use the website for personal, non-commercial purposes.

5. Coaching feedback — not medical advice

Important: CaddiQ provides AI-generated swing analysis and coaching suggestions for general informational and educational purposes. It is not medical, physiotherapy, or sports-medicine advice.

The "Injury Watch" feature highlights movements that are statistically associated with stress on common golf injury sites. It is not a diagnosis and should not be treated as one. Always consult a qualified medical professional, physiotherapist or accredited golf coach before changing your technique, beginning a new training programme, or if you experience pain or discomfort.

You assume all risk associated with playing golf and following any coaching feedback from the Service.

6. Subscriptions and payments

Some features of the Service may require a paid subscription. Subscriptions are processed by Apple via the App Store and are governed by Apple's payment terms in addition to these Terms.

Subscription pricing, billing cycles and renewal terms are disclosed in-app at the point of purchase. You can cancel a subscription at any time through your Apple ID settings; cancellation takes effect at the end of the current billing period and we do not provide refunds for partial periods except where required by Australian Consumer Law.

7. Intellectual property

All intellectual property in the Service — including the CaddiQ name, logo, app code, website, designs, AI prompts, and analysis methodology — is owned by or licensed to UJENGA PTY LTD. Nothing in these Terms transfers any IP to you.

You retain ownership of the swing videos and other content you upload ("Your Content"). You grant us a worldwide, royalty-free licence to host, store, process and analyse Your Content for the sole purpose of providing the Service to you. We do not claim ownership of Your Content and will not use it to train AI models or for any purpose unrelated to providing the Service to you.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which forms part of these Terms.

9. Beta releases

If you use the Service through TestFlight or any other beta programme, you acknowledge that the Service may contain bugs, may be unstable, and may change without notice. Beta features are provided "as is" without warranty.

10. Disclaimers and Australian Consumer Law

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We make no warranties about uptime, accuracy of analysis, or fitness for a particular purpose, and we disclaim all implied warranties except those that cannot be excluded.

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other rights that cannot be excluded.

Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to: (a) re-supplying the Service; or (b) refunding the amount you paid for the Service in the 12 months preceding the event giving rise to the claim.

11. Limitation of liability

To the extent permitted by law, neither party is liable to the other for indirect, special, incidental, consequential or punitive damages, loss of profits, loss of revenue, loss of data, or loss of business opportunity arising out of or in connection with the Service.

Our total aggregate liability to you in connection with the Service in any 12-month period is capped at the greater of (a) AUD $200, or (b) the total subscription fees you paid us in that period.

12. Indemnity

You agree to indemnify and hold us harmless from any third-party claim arising from (a) your breach of these Terms, (b) Your Content, or (c) your misuse of the Service.

13. Termination

You may stop using the Service and delete your account at any time from in-app settings.

We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if we discontinue the Service. We will give reasonable notice of discontinuation where practicable.

Sections 5, 7, 10, 11, 12 and 14 survive termination.

14. Governing law and jurisdiction

These Terms are governed by the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland and the courts of appeal from them.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the app or by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
